Eindhoven or Amsterdam prepares and files Dutch residence applications, keeps the file within the deadlines of the Immigration and Naturalisation Service (IND), and challenges a refusal. You usually do not need one for a routine extension with unchanged circumstances, but you do when the outcome turns on judgement: a borderline salary, a business plan, proof of a relationship, or a refusal with the four-week objection period running.
This article explains when legal help is worth the cost, where the main residence routes go wrong, which IND deadlines are decisive and how to choose a lawyer.

When do you need an immigration lawyer?
When the result depends on an assessment rather than on filling in forms. EU, EEA and Swiss nationals need no residence permit, and an extension filed by a recognised sponsor with the same job and salary is ordinary administration.
Legal help pays off in these situations:
- ອົບພະຍົບທີ່ມີທັກສະສູງ and EU Blue Card applications where the salary, the job or the sponsor status is not clear-cut;
- entrepreneurs applying under the self-employed route or the start-up scheme, where the business plan is the application;
- US and Japanese nationals relying on the treaty route for business owners;
- family reunification where the relationship must be proved across several countries or the sponsor’s income is irregular;
- naturalisation where dual nationality or a gap in lawful residence is an issue;
- any refusal, withdrawal or intended withdrawal, and cases involving earlier overstay or a criminal record.
What is the difference between a lawyer and a consultant?
A lawyer (advocaat) is registered with the Netherlands Bar, bound by its professional rules, subject to disciplinary supervision and protected by legal professional privilege. A consultant or relocation agency is not.
Under Article 8:24 of the General Administrative Law Act (Awb) anyone may represent you before the administrative court, but objection and appeal proceedings require knowledge of procedural law and case law. Instructing a lawyer from the start avoids handing over the file at the moment it becomes contentious and the deadlines are shortest. Where do the main residence routes go wrong?
The Netherlands has no general work visa but a set of residence purposes, each with its own conditions. Most refusals result from a weak file, not from the law.
The highly skilled migrant route requires an employment contract with an employer recognised by the IND as a sponsor and a gross monthly salary at or above the applicable criterion. The IND sets different amounts by age and for graduates and adjusts them every year on 1 January; check the IND table for the year of filing and whether the amount excludes holiday allowance. See our article on the
The EU Blue Card has a different salary threshold and requires a higher education qualification, or for certain ICT occupations comparable professional experience. Have a foreign diploma evaluated by Nuffic at the start, because that takes time.
Entrepreneurs and the treaty route
The self-employed route is assessed on a points system for experience, the business plan and the added value for the Dutch economy, on advice from the Netherlands Enterprise Agency (RVO). The start-up scheme gives founders working with a recognised facilitator a limited period of residence, after which they must switch to the self-employed route.
US and Japanese nationals can obtain residence under a treaty route if they invest a minimum amount in their business and keep it there. Confirm the IND’s current amount before incorporating the company.

A permit for a partner or minor child requires proof of the relationship, sufficient and lasting income of the sponsor and, in many cases, a civic integration exam abroad. The income requirement is linked to the statutory minimum wage, which changes on 1 January and 1 July. Documents must be legalised in the country of origin and translated by a sworn translator, which is often the longest step.
Under Article 8 of the Dutch Nationality Act (Rijkswet op het Nederlanderschap) you can apply for naturalisation after at least five years of lawful residence immediately before the application, among other conditions. You must pass the civic integration requirement and in principle renounce your current nationality, with exceptions. A gap in lawful residence, sometimes years earlier, restarts the clock.
Which IND deadlines are decisive?
Under Article 25 of the Aliens Act 2000 (Vw 2000) the IND must decide on most residence applications within 90 days. Applications from a recognised sponsor are usually decided much faster, but 90 days is the legal limit to plan against.
The period starts once the application is complete and is suspended while the IND waits for missing documents. Since 15 April 2025 the IND no longer owes an administrative penalty (dwangsom) for a late decision; the court can still order the IND to decide within a set period.
- Request for information: the IND sets a period, often short. A late answer can lead to refusal on that ground alone.
- ຈຸດປະສົງ: under Article 69 Vw 2000 the period for an objection (bezwaar) or appeal is four weeks, not the six weeks of the Awb. A late objection is declared inadmissible.
- ການບັນເທົາທຸກຊົ່ວຄາວ: an objection does not automatically suspend a decision. If you must stop working or leave, ask the court for a provisional measure (voorlopige voorziening, Article 8:81 Awb) without delay.
After a rejected objection you can appeal to the district court and, in most cases, further to the Administrative Jurisdiction Division of the Council of State (Raad van State).

Practices charge an hourly rate, a fixed fee for a defined application, or a fixed fee for filing plus an hourly rate for anything that follows. Ask for a written quotation that states the scope, who does the work and what an objection would cost.
On top of the fee come the IND’s application charges, which differ per residence purpose and are not refunded on refusal; legalisation and sworn translations; and court fees in appeal proceedings. VAT is charged on legal services, unless the reverse charge applies to a client established outside the EU. Law & More does not work on the basis of subsidised legal aid (toevoeging).

- Does the contract state a gross monthly salary that meets this year’s criterion, excluding holiday allowance where required?
- Do you report changes, such as a lower salary or the end of employment, to the IND in time?
- Do you keep the sponsor administration up to date?
